O’Hagan Meyer Partner Dean Falavolito, with associates Alex Boyer and Aaron Walayat assisting, was successful achieving dismissal of a Pregnancy and Gender Discrimination case filed in the United State District Court for the Eastern District of Pennsylvania. The plaintiff in the case claimed that the O’Hagan Meyer client discriminated against her in that following her return from pregnancy leave, that she was not permitted break times to express breast milk and was ultimately fired because of this request. O’Hagan Meyer was able to build a comprehensive record showing that the client terminated the plaintiff because of a medical error and that it had otherwise fully accommodated the plaintiff. The Court, citing the FLSA, the Pregnancy Discrimination Act, and Title VII of the Civil Rights Act agreed with O’Hagan Meyer’s argument and dismissed the plaintiff’s claims in their entirety.
