Recently, Kevin M. O’Hagan and Laura K. Musick won a combined motion to dismiss a breach of contract action on behalf of their client, an engineering and surveying corporation. The plaintiff, a property developer, improperly attempted to include extra-contractual terms in its claimed contract with the engineering and surveying corporation. The judge entered an order granting Defendant’s motion due to Plaintiff’s complaint’s legal deficiencies, namely its utter failure to sufficiently allege a breach of contract based upon terms outside of the alleged contract.
