- Professional Overview Dan represents clients in a host of litigation and regulatory matters. In addition to his general civil litigation experience, Dan has handled a variety of maritime, trade, trucking and transportation matters, as well as insurance and reinsurance disputes and premises liability cases. He has experience in both state and federal court trials and appeals, as well as mediation and arbitration proceedings. Dan represents financial institutions, debt buyers, national and community banks, mortgage lending institutions, loan servicers, auto-finance companies, credit card issuers, as well as other first-party creditors, and consumer reporting agencies in litigation in federal and state courts throughout the country. Provided guidance on regulatory issues and helped clients navigate interactions with state and federal regulators regarding compliance with consumer protection statutes, including the Fair Credit Reporting Act (FCRA), Fair Debt Collection Practices Act (FDCPA), Telephone Consumer Protection Act (TCPA), Electronic Fund Transfer Act (EFTA), Truth in Lending Act (TILA), Equal Credit Opportunity Act (ECOA), Real Estate Settlement Procedures Act (RESPA), the Racketeer Influenced and Corrupt Organizations Act (RICO), and others. He assists in the creation of client risk management and mitigation strategies in response to challenges by federal agencies, state attorneys general, as well as industry safety alerts, warning letters, and Freedom of Information Act (FOIA) requests. Dan has represented U.S. and non-U.S. businesses during government inspections, investigations, and enforcement actions. Helped clients satisfy licensing and permitting requirements, including application preparation and submission, as well as public hearings and appeals.
