- Professional Overview Dan’s practice involves federal and state court litigation as well as regulatory compliance counseling. Emphasizing proactive client engagement to develop early assessments that minimize risk exposure, Dan draws upon his courtroom experience and diverse industry background to craft workable solutions to the unique legal issues presented in each case. In addition to his general civil litigation experience, Dan has handled a variety of cases across diverse industry sectors, including maritime, trade, and transportation matters, as well as insurance and reinsurance disputes, construction, government contracting, employment and premises liability suits. Additionally, Dan has defended institutional clients in suits arising under various federal and state consumer protection statutes. Dan’s courtroom experience includes state and federal court trials and appeals, in addition to participating in numerous mediation and arbitration proceedings. Dan has represented corporate and maritime clients, including vessel owners, marine terminal operators, and other shore-side commercial entities, in a variety of matters. He has served as Club Correspondent to several International Protection & Indemnity Clubs (P&I) in the Port of Virginia, and elsewhere in the United States, providing 24-hour marine incident response services. Dan’s representation also includes vessel owners and operators in casualty investigations and adversarial proceedings involving the National Transportation Safety Board (NTSB) and U.S. Coast Guard. Dan has also advised foreign passenger vessel operators on regulatory matters involving compliance with international treaties and federal maritime laws, as well as state-specific licensing requirements impacting cruise operations in U.S. ports. Dan has further counseled clients in connection with government contracting matters involving Federal Acquisition Regulations (FAR), Defense Federal Acquisition Regulations (DFAR), issues arising under the Competition in Contracting Act (CICA), compliance with state and federal contract regulations, including claims under the Contract Disputes Act (CDA), Bid Protests, Contract Appeals, Cooperative Research and Development Agreements (CRADA), Federal Mentor-Protégé Programs, and 8(a) Program Compliance. Additionally, Dan has experience representing financial institutions, debt buyers, debt collectors (including law firms), national and community banks, mortgage lending institutions, loan servicers, auto-finance companies, credit card issuers, and other first-party creditors and consumer reporting agencies in litigation in federal and state courts throughout the country. He has defended litigation initiated in jurisdictions throughout the country and provided guidance on regulatory issues concerning compliance with the Fair Credit Reporting Act (FCRA), Fair Debt Collection Practices Act (FDCPA), Telephone Consumer Protection Act (TCPA), Electronic Fund Transfer Act (EFTA), Truth in Lending Act (TILA), Equal Credit Opportunity Act (ECOA), Real Estate Settlement Procedures Act (RESPA), the Racketeer Influenced and Corrupt Organizations Act (RICO), and others. Dan has also assisted clients implement risk management and mitigation strategies in response to challenges by federal agencies and state attorneys general, as well as industry safety alerts, warning letters, and Freedom of Information Act (FOIA) requests.

- Served as U.S. counsel to French cruise line on all regulatory compliance matters for passenger vessel operations throughout North America, including satisfaction of Federal Maritime Commission (FMC) licensing and bonding requirements for foreign-flagged fleets, Department of Homeland Security (DHS) and Customs and Border Patrol (CBP) security compliance measures, Passenger Vessel Safety Act (PVSA) obligations, U.S. Coast Guard (USCG) Port State Control protocols, and the submission of licensing applications with the Department of Treasury’s Office of Foreign Assets Control (OFAC) to exempt cruise operations between the United States and Cuba.
- Obtained acquittal following federal jury trial on behalf of defendant chief engineer for foreign flagged vessel operator charged with crimes under the Oil Pollution Act of 1990 (OPA) and making false statements under the Clean Water Act (CWA) where crewmember-whistleblowers alleged defendant had directed bypassing the ship’s oily-water-separator (OWS) in violation of the Act to Prevent Pollution from Ships (APPS).
- Successfully represented designated parties in interest subject to formal investigations and public hearings initiated by the National Transportation Bureau (NTSB) and U.S. Coast Guard (USCG) following mass marine casualties and other reportable incidents involving the loss of life, vessel collisions, groundings, loss of propulsion, and significant harm to the environment.
- Achieved defense verdict following bench trial on behalf of marine terminal operator and negotiated favorable settlement on appeal where tractor-trailer owner-operator alleged terminal straddle carrier caused damage to Plaintiff’s vehicle during container interchange.
- Successfully resolved prospective maritime wrongful death action on behalf of marine insurer in recreational boating case where insured vessel operator’s violations of the Inland Navigational Rules resulted in fatal collision.
- Negotiated favorable resolution of pre-suit demand on behalf of multinational shipping company in connection with multiple claims under the Carriage of Goods at Sea Act (COGSA) where negligence of stevedore for marine terminal operator found to have caused damage to container and chemical cargo contained therein.
- Obtained favorable settlement on behalf of commercial sight-seeing vessel owner/operator in connection with fatal incident involving kayakers crossing Rudee Inlet by successfully raising narrow channel defense after petitioning the Eastern District of Virginia for relief under the Shipowner’s Limitation Act of Liability Act.
- Achieved favorable settlements for commercial and recreational vessel owners and operators in multiple federal declaratory judgment actions initiated on behalf of and against marine insurers.
- Obtained favorable settlement on behalf of international towing company following mediation after successfully consolidating multiple Jones Act suits seeking Maintenance and Cure that were filed by several injured tugboat crewmembers in separate state and federal court actions.
- Advised client on successful implementation of compliant 8(a) Program certification, Small Business Administration (SBA) registration and proof of status as a Disadvantaged Business Enterprise (DBE), as well as additional issues related to applicable federal government contracting opportunities.
- Advised client in connection with successful presentation of bid and subsequent provision of title and right-of-way services to federal and state government agencies, including the Department of Transportation (DOT); Virginia Department of Transportation (VDOT), U.S. Army Corps of Engineers (USACE), Department of the Interior (DOI), Bureau of Land Management (BLM), and the U.S. Parks Service. Further advised client in connection with negotiation and prepared master service agreements (MSA), statements of work (SOW), and memoranda of understanding (MOU) for services provided to government agencies.
