Government Contract Bid Protests and Disputes
Ms. Brakstad provides strategic advice and counsel to government contractors, their management, and investors. She assists businesses of all types, sizes, and experience levels, in matters ranging from a few thousand dollars to millions of dollars. On behalf of her clients, Ms .Brakstad has successfully protested improper awards and defended proper awards made by the government in bid protests (state protests, agency protests, GAO, Court of Federal Claims, and Court of Appeals for the Federal Circuit) as well as status protests before the Small Business Administration. She also assists her clients with contract disputes and claims against the government, complex commercial litigation, intellectual property and trade secrets, unfair competition, business torts, and other civil litigation matters.
Government Contract Advising and Compliance
Ms. Brakstad is experienced in the day-to-day issues facing small businesses and the complex and specific legal questions facing large civil and defense contractors. She guides clients through all aspects of the government contracting programs offered by the SBA, including navigating federal regulations concerning potential affiliation; limitations on subcontracting; teaming arrangements; joint ventures; the mentor-protégé program; and small business, 8(a), DBE, WOSB, HUBZone, and SDVOSBC status issues. She has provided counseling on various issues and risks associated with the Buy America and Buy American Acts. She has also counseled clients on establishing, enforcing, and maintaining overall compliance programs under state and federal programs.
Government Contract Transactions
Ms. Brakstad counsels clients on strategic acquisitions and investments in government contractor targets. She has assumed numerous roles in the mergers and acquisitions of government contractors, including assisting with transactions, drafting agreements, due diligence review and compliance with U.S. Department of Veterans Affairs, and Small Business Administration notice and approval requirements, as well as counseling on the novation of contracts.
Ms. Brakstad received her B.A. in Psychology from the University of Virginia and her J.D. with honors from the University of Richmond’s T.C. Williams School of Law where she was a Marshall Scholar and worked as the Executive Editor of the Journal of Law and the Public Interest. She previously interned for the Honorable Dennis W. Dohnal, U.S. Magistrate Judge for the Eastern District of Virginia.
Ms. Brakstad actively volunteers in the legal field, representing indigent clients in family law matters and members of the United States Armed Forces through the American Bar Association’s Military Pro Bono program.
