Brett Ferguson is an Associate in the Employment practice at O'Hagan Meyer. He represents employers in a variety of employment cases and administrative actions, including claims for civil rights violations, harassment, discrimination, retaliation, wrongful termination, Fair Employment and Housing Act (FEHA) violations, American Disabilities Act (ADA) violations, unfair business practices, as well as Private Attorney General’s Act (PAGA), and wage & hour claims of Labor Code and Wage Order violations in both the individual and class action context.
Brett represents employers in both state and federal courts, in arbitration, mediation, and before state and federal agencies, such as the Equal Employment Opportunity Commission, the California Civil Rights Department, the California Employment Development Department, the California Unemployment Insurance Appeals Board, and the Division of Labor Standards Enforcement. Brett’s practice includes successful appellate work, where he has won several writ petitions on behalf of his clients. Brett also conducts HR best practices audits, workplace investigations, and provides preventive counseling to his clients to help them ensure that compliant HR policies and documents are in place. In addition, Brett works with employers to establish compliance with the California Consumer Protection Act. Brett has also engaged in lobbying efforts on behalf of association clients.
